How To Protect Yourself If You Have Been Sued by Midland Credit Management

sued by Midland Funding

Have you received notice from Midland Credit Management or Midland Funding that you are being sued for an unpaid debt? If so, there is a good chance you had never heard of Midland prior to receiving notice of a lawsuit.

Most people never hear of Midland Credit Management or Midland Funding until they receive notice of a lawsuit. This is because the company tends to skip the typical collection activities preferring to go straight for a lawsuit.

Who is Midland Credit Management and Midland Funding?

Midland Credit Management is a subsidiary of Midland Funding and is one of the largest debt collectors in the United States with reported revenues of over $1 billion in 2017.  They are based in San Diego, California and are part of the Encore Capital Group.

Midland Credit Management and Midland Funding are companies that buy debts from other creditors for cents on the dollar, and then file lawsuits to recover the full amount of the debt.

Midland files thousands of lawsuits every year hoping the debtor won’t speak with a lawyer to learn about their rights, and will simply agree to a payment plan.

They are especially aggressive in suing people for unpaid credit card debt. Their strategy is to sue people for the debt and then get them to agree to a payment plan. Many people will either ignore the lawsuit or agree to a payment plan. However, that could be a mistake because companies that purchase debt sometimes sue consumers for debt even when they have no legal grounds for the lawsuit.

For example, they may sue you after the time limit for filing a lawsuit (statute of limitations) has expired. This is why it is so important that you contact an attorney who can explain your rights and the best course of action. Don’t risk making payments on an old debt you no longer owe.

If Midland Credit Management or Midland Funding sues you, the first thing you should do is consult with an attorney who can review your situation and determine if the lawsuit is valid.

What To Do If You Have Been Sued by Midland Credit Management or Midland Funding

If you’ve been sued by Midland Credit Management or Midland Funding, it won’t go away by ignoring it. It is important that you understand that you have rights as a consumer and to protect those rights you need to contact an attorney for immediate assistance.
